RENTAL GUIDELINES
Golf Clubs Away, LLC (“we”, “our”
or “GCA”) hereby agrees to sell or rent golf clubs or
other golfing equipment to you in accordance with these Rental
Guidelines. You may select products to rent and/or purchase and have
them delivered to your designated delivery location.
Rental
Period
The Rental Period is defined as that period of time,
which shall be no less than one (1) day, for which you have reserved
to rent golf equipment from us. The Rental Period shall commence in
the morning on the day of your rental and shall terminate in the
evening on that same day (unless your reservation is for multiple
days, in which event, in shall terminate in the evening on the final
day of your Rental Period).
Payment
The rental or
purchase of our golf equipment requires you to supply us with
complete, accurate and current credit card information for a valid
credit card for which you are the authorized user. By completing the
check-out process, you authorize us or our agent to bill your credit
card the applicable per-item or rental fees, any and all applicable
taxes, and any other charges you may incur in connection with your
use of the Website. The applicable rental fees will be charged to
your credit card on the date your rental or purchase is initiated.
We
reserve the right to determine whether your credit card is
pre-authorized to accept a minimum charge equal to the current retail
value of the product in case you fail to return or you damage a
product.
Cancellation Policy
Cancellations for
equipment rentals must be confirmed at least 48 hours prior to the
Rental Period (as defined below) for there to be no fee charged. If
you cancel your rental by 8:00pm (EST) on the day prior to the Rental
Period, you will be charged a $10 restocking fee. If you cancel your
rental after 8:00pm (EST) on the day prior to the Rental Period, you
will be charged one (1) day’s rental
fee.
Delivery/Commencement of Rental Period
We
will make our best effort to deliver rental clubs to your designated
delivery location no later than 7:00 am (EST) on the day your Rental
Period begins. In order to make arrangements for time or method of
delivery other than as set forth above, you must speak with a
customer service person. Customer service may be reached at
(954-615-2326). Additional charges may be incurred for specialized
delivery services.
Substitutions
We reserve the
right to substitute club(s) of equal or better quality than those
requested by you.
Your Responsibility
You hereby
understand that while the golf equipment is in your possession, YOU
ARE SOLELY RESPONSIBLE FOR THE EQUIPMENT RENTED TO YOU. You are to
use the golf equipment for its intended recreational use only and not
for any other reason. You shall not remove, alter, disfigure or cover
up any numbering, lettering, bar code or insignia displayed upon the
equipment, and shall see that the equipment is not subjected to
careless, unusually or needlessly rough usage. You must return the
equipment to us in the same condition as delivered, ordinary wear and
tear resulting from proper use thereof alone
expected.
Usage/Non-Usage
You are responsible
for all payments due for renting our golf equipment whether or not
you are able to use, or you actually do use such equipment that is
delivered to you on the date of your Rental Period. No rain checks or
refunds will be given due to change in vacation itinerary or
inclement weather, unless we, in our absolute and sole discretion,
determine that due to inclement weather conditions, no deliveries of
golf equipment will be made on the date of your Rental Period. In
such event, you may exchange your Rental Period for another date or
contact customer service (954-615-2326) for a refund. In order to
receive a refund, you must speak with customer service no later than
12:00 pm on the date of your Rental Period.
Missing or
Damaged Clubs Upon Delivery
In the event that you do not
receive your clubs by the designated delivery time, or if any of the
clubs are missing or damaged, you must contact customer service
(954-615-2326) no later than 10:00 am (EST) to notify us of the
problem. If available, we will use our best efforts to supply
substitutes for the missing/damaged clubs within two (2) hours of
such notification
Missing or Damaged Clubs Upon Return
In
the event that any of the equipment is not returned to us, lost,
stolen, broken or in the event that any of the returned equipment is
in a state of damage that exceeds normal wear and tear, as determined
by us in its sole and absolute discretion, you expressly authorize
that we may immediately make a charge to your credit card in the
amount of the replacement cost for such lost, stolen, broken or
damaged item(s). You hereby authorize us to charge your credit card
in the amount of our cost to replace such damaged or missing item(s),
plus all other fees incurred, such as, but not limited to, shipping
and handling costs. We have no duty to mitigate our replacement
cost(s), including any attempt to fix or find such damaged or missing
item(s).
Extension of Rental Period
If you wish
to extend the Rental Period at any time after 8:00 pm (EST) the day
prior to the Rental Period, you may do so by calling customer service
only. Pricing for the extension is subject to availability, and is
only available via telephone inquiry.
End of Rental
Period
At the conclusion of the Rental Period, you shall
leave the clubs with an authorized person at the drop-off location
(either the Concierge at a hotel or the Club Pro at a golf course)
who is available 24/7. The clubs shall be made available for pick up
no later than 8:00 pm (EST) on the last day of the Rental Period. In
the event that the clubs are not made available by the requisite time
at the end of the Rental Period, it will be considered a late return
and the Rental Period shall be deemed extended for an additional day
and you will be charged a $100 extension fee for each day the clubs
are not made available for pick-up to GCA.
Liability
In
no event shall GCA be liable to you for any amount exceeding the
rental fee.
